Tendheart Terms of Service
DRAFT. NOT LEGAL ADVICE. NOT REVIEWED BY A LAWYER. This launch draft describes the current web app. Legal review is still pending.
Effective date: November 6, 2026.
Operator: Barella Ventures LLC, an Oregon limited liability company. Contact form.
1. Agreement and eligibility
By confirming the age/terms checkbox and using Tendheart, you agree to these terms and acknowledge the Privacy Policy. If you do not agree, do not use the service. You must be 18 or older and a U.S. resident outside Illinois and Nevada. Children may not use the app, even with a parent. State and age checks rely on your truthful self-declaration. Do not bypass eligibility or safety restrictions.
2. Education, not professional care
Tendheart provides lessons, quizzes, fictional AI role-plays and automated feedback to practice communication. It is not therapy, counseling, medical care, diagnosis, child-development assessment, legal advice, or a crisis service. It does not create a professional or confidential care relationship. Scores are practice indicators, not assessments of you or your family. No clinician reviews AI replies before you see them. Research citations do not imply endorsement by the researchers.
Do not use the service to decide custody, legal, medical, school, disciplinary, or child-protection matters. Seek qualified help for health, safety, development, abuse, or other serious concerns. Communication techniques can be unsafe in an abusive or coercive relationship.
3. Emergencies
Tendheart is not monitored in real time and cannot provide emergency help. In immediate danger call 911. For suicidal thoughts or self-harm, call or text 988. For domestic violence, call 1-800-799-7233 or text START to 88788. The automated safety screen may miss a crisis or flag harmless text. Do not rely on it. The app does not automatically contact emergency services.
4. AI limitations and data
Practice partners are software, not real people or clinicians. Simulated children, partners and coworkers are fictional. AI responses can be inaccurate, biased, offensive or inappropriate. Evaluate them yourself and do not treat them as professional advice. Do not enter real names, health information, or identifying details about children or others. Practice text is sent to Google Gemini as described in the Privacy Policy; provider data handling depends on the applicable service terms.
5. Acceptable use
Do not use Tendheart to break the law, harm or harass anyone, submit sexual content involving minors, impersonate someone, collect information about others without authority, evade safety or rate limits, attack the service, or infringe rights. Use it for your own lawful communication-skills practice. You are responsible for what you submit and for your actions outside the app.
6. Content
You retain whatever rights you have in your messages. You permit us and our providers to process them as needed to deliver the requested practice and feedback. AI output may not be unique and may not qualify for ownership protection. Tendheart branding, software and lessons belong to their respective owners. We grant you permission to use the app for personal, noncommercial skills practice, subject to these terms.
7. Free launch and availability
This build is free. There are no accounts, paid plans, subscriptions, automatic renewals or payment collection. Joining the waitlist does not create a purchase. Any future paid offering will require separate pricing and agreement before charges. AI usage is limited, and limits may change. Daily caps are best-effort and may reset with serverless instances. The service may be unavailable, changed, suspended or discontinued. Local progress can be lost when you clear browser data or reset it; no cloud backup is provided.
8. Warranties and responsibility
To the extent permitted by law, the service and AI output are provided “as is” and “as available,” without warranties of accuracy, suitability, uninterrupted availability, or any particular relationship or parenting outcome. You remain responsible for deciding whether any communication technique is appropriate and safe for your circumstances.
9. Liability
To the extent permitted by law, Barella Ventures LLC is not liable for indirect, incidental, special or consequential losses arising from use of the service, and its total liability for claims relating to this free service is limited to US $100. Nothing in these terms limits liability or consumer rights that cannot lawfully be limited, including liability for fraud or willful misconduct. This clause remains subject to legal review.
10. Ending use and changes
You can stop using the app at any time. Reset local progress in Settings or clear browser data to remove device data. Contact us separately to request removal from the waitlist or deletion of form submissions. We may restrict access for misuse and update these terms by publishing a revised effective date. Review changes before continuing to use the service.
11. Governing law and questions
Oregon law applies to the extent permitted by applicable law, without limiting mandatory consumer protections where you live. This launch draft does not include a binding arbitration agreement, class-action waiver, or a non-compete restriction.
